Do’s and Don’ts of Taking Photos After an Accident

Following a car accident, you should always take photos to document what happened so that you have photo evidence. While taking photos is advised, you should know that there are several “do’s and don’ts” about taking these photos and what to do with them afterward.

Why You Should Take Photos

The traumatic feeling of an accident can easily cause anyone to forget important details that their attorney may need to settle or litigate their case. Photographing everything will allow your attorney to have a clear and accurate picture of the accident without undue delay. Additionally, photos will allow your memory to be refreshed more vividly about what happened.

Most importantly, the photos you take immediately following a car accident will document proof of your claim. No one will be able to imagine the scene of the accident better than when you have photos to illustrate exactly what happened unless they were actually there. If you can, try to have your photos time stamped to show the date and time that they were taken for further accuracy.

What Photos You Should Capture

If you are too injured to take photos of the accident scene, try to have a friend or family member take them for you. You or your family and/or close friends should make sure to take photos of:

  • Your vehicle
  • The other person or people’s vehicles
  • Any property and/or vehicle damages
  • The surrounding location including road signs, stoplights, and businesses that may have security camera footage
  • Your injuries
  • Anything else that you think may be helpful

What Not To Do

As important as is it is to document what happened, you should also keep in mind things not to do. Keep the photos that you have taken between yourself and your attorney, and never post them on social media. As tempting as it might be to discuss your frustrations and what happened to your friends and family, insurance companies are capable of seeing your public social media posts and you never know what can be used against you when trying to reach a compensation agreement.

Lastly, although it is easy to lose your temper and get angry with the person who was at fault for the accident, you must remember to remain calm so that you can remember what happened as well as photograph it. Losing your temper can cause you to forget or miss important details that could win your case. Regardless, it is always best to remain civil and avoid future disputes.
