Legal Highlight: Pre-Existing Conditions and Motor Vehicle Accidents

Pre-existing conditions are medical conditions that an individual may be suffering from prior to the involvement in a crash. People of all ages and backgrounds may suffer from pre-existing conditions that could be aggravated in the event of a motor vehicle crash.

Virginia law recognizes this thankfully, if a preexisting condition is aggravated, or worsens, as a result of a crash then the individual may still be compensated for any increased injury, damage or difficulty of treatment that resulted from the crash. Some examples of pre-existing conditions are arthritis, PTSD, neck or back pain, and concussions or traumatic brain injuries.

Although an individual will not be compensated for the underlying condition itself, he or she can be compensated for any increased issues, damages, or treatments that are directly attributed to the crash.
