Updates to the Virginia Workers’ Compensation Act

Updated legislation regarding the Virginia Worker’s Compensation Act went into effect on July 1, 2023.

  1. Va. Code § 65.2-107 was amended to add anxiety disorder and depressive disorder to the PTSD presumption for law enforcement officers and firefighters.
  2. Va. Code § 65.2-402 was amended to expand the cancer presumption to include:
  • bladder and thyroid cancers.
  • arson investigators or bomb investigators employed by the Department of State Police.
  • members of the State Police Officers’ Retirement System who collect, analyze, or handle hazardous materials, infectious biological substances and radiological agents, fentanyl, or methamphetamine.
  1. Va. Code § 65.2-802 was amended to allow two or more Group Self-Insured Associations (GSIAs) to merge under the following conditions:
  • The merger must be approved by the State Corporation Commission.
  • The resulting GSIA assumes all obligations of the merged GSIAs.
